1. Acceptance of Terms
By accessing or using MariciSelect ("the Platform"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
MariciSelect provides an AI-powered recruitment platform that enables agencies and employers to discover candidates, manage hiring pipelines, conduct outreach, and analyze recruitment performance. The Platform includes features such as AI candidate matching, multi-channel communication, job management, and analytics reporting.
3. Account Registration
To use the Platform, you must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Subscription Plans and Billing
The Platform offers various subscription tiers with different feature sets and usage limits. Pricing, features, and limits for each plan are described on our pricing page. We reserve the right to modify pricing with 30 days' notice. Subscriptions renew automatically unless cancelled before the renewal date.
5. Acceptable Use
You agree to use the Platform only for lawful recruitment purposes. You shall not use the Platform to discriminate against candidates based on protected characteristics, send unsolicited bulk communications in violation of applicable laws, attempt to reverse-engineer or extract AI models or algorithms, share your account credentials with unauthorized parties, or upload malicious content.
6. Data and Content
You retain ownership of all candidate data, job descriptions, and other content you upload to the Platform ("Your Content"). By uploading content, you grant us a limited license to process, store, and display it as necessary to provide our services. You are responsible for ensuring you have the legal right to upload and process any candidate data.
7. AI-Generated Content
The Platform may generate content using AI, including candidate summaries, match scores, and outreach drafts. AI-generated content is provided as a tool to assist your recruitment process and should be reviewed before use. We do not guarantee the accuracy of AI-generated content.
8. Data Protection Compliance
You are responsible for ensuring your use of the Platform complies with applicable data protection laws (e.g., GDPR, CCPA) in your jurisdiction. This includes obtaining any necessary consents from candidates before processing their personal data through the Platform.
9. Intellectual Property
The Platform, including its software, design, and documentation, is owned by MariciSelect and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Platform during your subscription period.
10. Limitation of Liability
To the maximum extent permitted by law, MariciSelect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid for the Platform in the twelve months preceding the claim.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.
12. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Platform will be revoked. You may request an export of your data within 30 days of termination. We reserve the right to suspend or terminate accounts that violate these terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
14. Changes to Terms
We may update these Terms from time to time. We will provide notice of material changes via email or through the Platform. Continued use after changes constitutes acceptance.
